EU Commission to Be Sole Enforcer of Tech Rules, EU Countries Agree

Officials said on Monday that representatives from EU nations have agreed that the European Commission will be the only enforcer of new digital laws, with national antitrust watchdogs having a restricted role rather than the broader powers requested.

EU ministers will formally ratify the agreement as part of the bloc's unified position on 25 th of November, 2021, ahead of discussions with EU legislators and the Commission on the draft rules known as the Digital Markets Act (DMA), which must be approved before becoming law. With a list of dos and don'ts, the DMA, suggested by EU antitrust commissioner Margrethe Vestager last year, aims to limit the dominance of Alphabet unit Google, Facebook, Apple, and Amazon.

In a joint letter sent in June, German and French antitrust regulators, as well as their counterparts in the other 25 EU nations, urged for a larger role in implementing the DMA, citing their experience in digital matters. "The Commission is the single body authorised to apply this Regulation," according to an EU document obtained by Reuters that was accepted by a working group of the EU Council.

"Member states may authorize competent authorities enforcing competition rules to pursue investigative measures into alleged infringements of gatekeeper commitments in order to help the Commission," the paper stated. It said that the EU executive will have complete discretion in deciding whether or not to launch an investigation.
